Section 94-c of the Executive Law fast-tracks the siting of large-scale renewable energy projects to meet the State’s aggressive renewable energy goals. The newly created Office of Renewable Energy Siting has authority to supersede local land use approvals and most state approvals, and issue permits for the construction and operation of these projects. While municipalities still participate in Section 94-c proceedings, required community engagement is less than that under the existing siting process. This program will discuss the new siting process and how municipalities can prepare and effectively participate in the proceedings.
