The American legal system is founded on the rule of law - the idea that the only legitimate source of official authority is the duly enacted measures of the people’s authorized representatives. The concept of the rule of law is not, however, a free-standing principle; it is deeply rooted in principles of philosophical liberalism that undergird the entire constitutional order. This seminar will provide an overview of the rule of law - where it came from, the bitter struggles to achieve it, its role in the American constitutional order, the significance of recent challenges to its normative validity, and the special role of an independent bar in upholding and enforcing it.
